1. About Us

Maritime Building Supplies is a building-materials supplier based in Drafton, Nova Scotia, Canada. We are an authorized dealer for SuperForm ICF and MST-BAR fiberglass rebar and supply related building materials, accessories, and equipment rentals to customers across Nova Scotia, New Brunswick, and Prince Edward Island (the "Maritimes").

2. Use of the Site

You may use the Site for lawful purposes only. You agree not to use the Site in any way that could damage, disable, or impair it, or interfere with another party's use of it. We may modify, suspend, or discontinue any part of the Site at any time without notice. We make reasonable efforts to keep Site information accurate but do not warrant that it is complete, current, or error-free.

3. Quotes, Pricing & Product Information

3.1. Quotes and take-offs we provide are estimates based on the information available to us at the time and are valid for [e.g., 30] days unless stated otherwise. Quoted quantities are a guide; final quantities required for your project remain your responsibility to confirm.

3.2. Prices are quoted in Canadian dollars (CAD) and are exclusive of applicable taxes (including HST), delivery charges, and any third-party fees unless expressly stated. Prices are subject to change without notice until an order is confirmed.

3.3. Product descriptions, images, specifications, and performance figures shown on the Site or in marketing materials are provided for general information. Where figures originate with a manufacturer (for example, SuperForm or the maker of MST-BAR or Plumwall products), they reflect that manufacturer's published data, and we are not responsible for their accuracy. Confirm critical design values with your engineer or designer of record.

3.4. We reserve the right to correct any errors or omissions in pricing, descriptions, or availability, and to refuse or cancel any order arising from such an error, even after an order has been confirmed.

4. Orders & Payment

4.1. An order is accepted only once we confirm it in writing (including by email). We may decline any order at our discretion.

4.2. Payment terms, deposits, and accepted payment methods will be set out on your quote or invoice. Unless otherwise agreed in writing, payment is due [insert terms, e.g., in full before shipment / net 30 for approved accounts].

4.3. Title to goods passes to you only upon receipt of payment in full. Risk of loss passes to you upon delivery (or pickup) as described in Section 5.

5. Delivery & Shipping

5.1. We arrange delivery of products to jobsites and addresses across the Maritimes. Delivery dates and times are estimates and are not guaranteed. We are not liable for delays caused by carriers, weather, supply availability, or other circumstances beyond our reasonable control.

5.2. You are responsible for ensuring safe, legal, and reasonable access for delivery vehicles and for arranging unloading unless otherwise agreed. Additional charges may apply for failed deliveries, waiting time, or re-delivery.

5.3. You must inspect goods on delivery and note any visible shortage, damage, or error on the delivery documentation, and notify us within [e.g., 48 hours]. Risk of loss or damage passes to you on delivery or pickup.

6. Equipment Rentals (Including ICF Bracing)

6.1. Where we rent equipment such as Plumwall ICF bracing ("Rental Equipment"), the rental is governed by these Terms and any separate rental agreement or invoice, which together set the rental period, rates, and deposit.

6.2. You are responsible for the Rental Equipment from the time it is delivered or picked up until it is returned to us in the same condition, reasonable wear excepted. You agree to:

  • use the Rental Equipment only for its intended purpose and in accordance with the manufacturer's instructions and all applicable safety regulations;

  • keep it clean, secure, and protected from loss, theft, and damage; and

  • not sublet, modify, or repair it without our written consent.

6.3. You are liable for the full repair or replacement cost of Rental Equipment that is lost, stolen, or damaged beyond reasonable wear while in your possession, and for any cleaning charges and late fees for equipment returned dirty or after the agreed return date.

6.4. We are not responsible for any loss, injury, or damage arising from your use of Rental Equipment on site. Proper installation, bracing, shoring, and jobsite safety remain your responsibility and that of your contractor and engineer.

7. Returns & Cancellations

7.1. Cancellation and return policies, including any restocking fees, will be set out on your quote or invoice. Special-order, custom-cut, and non-stock items are generally non-returnable.

7.2. Returned products must be unused, in original condition and packaging, and approved by us in advance. Return shipping is the customer's responsibility unless the return results from our error.

8. Technical Information & Professional Responsibility

Any technical guidance, take-offs, sizing, or recommendations we provide are offered in good faith to assist your planning and do not constitute engineering, architectural, or professional design services. You are responsible for ensuring your project is designed, engineered, permitted, and built in accordance with all applicable building codes and the requirements of your engineer or designer of record.

9. Warranties

9.1. Manufactured products are covered solely by the applicable manufacturer's warranty (for example, SuperForm, MST-BAR, or Plumwall), and we will pass through such warranties to you where we are able. We make no independent warranty as to manufactured goods.

9.2. To the maximum extent permitted by law, and except as expressly stated, all products and services are provided "as is," and we disclaim all other warranties, whether express, implied, or statutory, including implied warranties of merchantability and fitness for a particular purpose.

10. Limitation of Liability

To the maximum extent permitted by applicable law, Maritime Building Supplies will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for loss of profits, revenue, data, or business, arising out of or related to the Site, our products, rentals, or services. Our total aggregate liability for any claim will not exceed the amount you paid for the product, rental, or service giving rise to the claim. Nothing in these Terms excludes liability that cannot be excluded under applicable law.

11. Indemnification

You agree to indemnify and hold harmless Maritime Building Supplies and its owners, employees, and agents from any claims, damages, losses, or expenses (including reasonable legal fees) arising from your breach of these Terms, your use of the Site, or your use, installation, or handling of products or Rental Equipment.

12. Intellectual Property

All content on the Site — including text, graphics, logos, and the Maritime Building Supplies name and logo — is owned by or licensed to us and is protected by applicable intellectual-property laws. You may not copy, reproduce, or use it without our written permission. Third-party names and marks (including SuperForm, MST-BAR, and Plumwall) are the property of their respective owners and are used for identification only.

13. Third-Party Links

The Site may contain links to third-party websites (such as manufacturers'). We provide these for convenience and are not responsible for the content, accuracy, or practices of those sites.

14. Privacy

Your use of the Site is also governed by our Privacy Policy, which explains how we collect and handle personal information.

15. Governing Law

These Terms are governed by the laws of the Province of Nova Scotia and the federal laws of Canada applicable therein, without regard to conflict-of-laws principles. You agree to the exclusive jurisdiction of the courts of Nova Scotia for any dispute arising from these Terms.

16. Changes to These Terms

We may update these Terms from time to time. The version posted on the Site is the current version, and your continued use of the Site or our services after changes are posted constitutes acceptance of the updated Terms.
